Dear Mr. Bildfell:—
The committee of which you are
chairman has directed my attention
to a letter from Sveinbjörn Johnson
of the University of Illinois to Dr. B.
J. Brandson, dated June 19th, 1928,
which appears in the issue of “Lög-
berg,” dated July 12th, 1928, and has
asked me for a legal opinion as to
some of the statements contained in
that letter. In the third paragraph
of Mr. Tohnson’s letter the follow-
ing statement is made:

A study of the particular items
included in this vote shows the var-
iety of subjects dealt with, none of
which have anythinig to do with
immigration. The main estimates
for the twelve months ending April
30th 1929 include the following it-
em: ‘Grant to Icelandic Association
$1,000.00.” This is included in
vote No. 14 of the main estimates
under the following heading:
TREASURY
“1 understand such an approp-
riation would have to be charg-
ed to the immigration account;
that it could not be justified on
any otiher account. Certainly
the government cannot legally
appropriate funds for any other
than a public purpose; conse-
quently, the fund expended would
have to be devoted to some use
beneficial to the provincial or
Canadian government. I can
see no iground save that it would
tend to encotirage Icelanders to
come to Canada.”
Further in the same paragraph
Mr. Johnson says:
■“The gravamen is that public
funðs, which the government
gave and could give for no pur-
pose other than to encourage
immigration, are used by our
people to promote interest in
Iceland and the celebration of
1930.”
The statements made in Mr. John-
■son’s letter with which I wish to
deal are that the grants from the
Saskatchewan government are charg-
ed to the Immigration account, and
that the Saskatchewan government
could make the grants for no other
purpose than to encourage immiigrat-
ion, and that it would be illegal for
the government to appropriate funds
to the Association for any other pur-
pose. In my opinion these state-
ments are absolutely incorrect, and
are based upon a misapprehension of
the manner in which the grants were
made, and the powers of the Sask-
atchewan legislature to make them

This vote also shows the great var-
iety of subiects on Which expendi-
tures were approved.
These two votes were passed by
resolutions of the Saskatchewan
Legislature, the elected representativ-
es. of the people of Saskatchewan.
After the resolutions approving of
these expenditures had been passed,
an Act of the Legislature was pass-
ed called “The Appropriation Act,
1928,” being Chapter 1 of the Stat-
utes of Saskatchewan 1928. To this
Act several schedules were attach-
ed, namely — A., B., C., D., and
E.
The itern of $55,208.00 being vote
No. 3 of the supplementary estimat-
es above referred to, which includes
the igrant of $1,000.00 to the Iceland-•
ic Association, is included in Sched-
ule “A” to the Appropriations Act
1928 under the following heading:

The item of $168,150.00 being vote
No.-14 of the main estimates above
referred to, include the grant of
$1,000.00 to the Icelandic Associat-
ion, is included in Schedule “Cv to
the Appropriations Act of 1928, und-
er the following heading:—
TREASURY
Miscellaneous (Charged to Revenue)
$168,150.00
Section 2 of the Appropriations Act
provides as follows:—
“From and out of the consolidated
fund there may be paid and applied
a sum not exceeding in the whole
one million one hundred and thirtv
five thousand five hundred and sixty
eight dollars towards defraying the sev
eral charges and expenses of the
puíblic service for the fiscal year
endinig on the thirtieth day of April,
one thousand nine hundred and
twenty-eight, not otherwise provided
for and set forth in schedules A and
B to this Act.”
Section 3 of the same Act provides
as follows:—
“From and out of the consolidated
fund there may be paid and applied
a sum not exceedinig in the whole
seventeen million, seven hundred and
twenty thousand three hundred and
thirty-eight dollars towards defray-
ing the several charges and expenses
of the public service for the fiscqj
year ending on the thirtieth dav of
April, one thousand nine hundred
and twenty-nine, not otherwise pro-
vided for and set forth in.the sche-
dules C and D in this Act.”
From the facts above outlined it
will t>e seen that the two grants of
$1,000.00 each to the Icelandic Ass-
ociation are not charged to, nor pay-
able from any immigration fund,
but are pavable out of the consoli-
dated fund of the Province of Sask-
atchewan. No conditions whátso-
ever are attached to the grant, eith-
er in the estimates as presented to
the Legislature or in the statutes pro-
viding for the appropriation of the
monies out of the consolidated
fund.
As a matter of law, the right of
the SaskatciVewan Legfslature to
make these grants in my opinion ad-
mits of no dispute. It is within the
legislative competence of the Legis-
lature of Saskatchewan to dispose
of its funds as it sees fit. Since
the Legislature of the Province has
voted these monies to the Icelandic
Association, it was quite proper for^
the Government of Saskatchewan to
pay them over to the Association
since in doing so they were carrying
out the will of the Legislature com-
posed as it is of the elected repre-
sentatives of the people. I do not
believe that any lawver of repute
would doubt the constitutional right
of the Legislature of Saskatchewan
to make the grants which it did. That
right in my opinion is so elementary
that it requires no further statement
with regard to it. In my opinion
the Legislature of Saskatchewan in
voting these monies acted within its
powers. The monies which were
paid out were paid out of the con-
solidated fund of the Province of
Saskatchewan in pursuance of the
Appropriation Act of 1928.
Mr. Johnson states in his letter
that the Government cannot legally
appropriate funds for any other than
a puiblic purpose. In answer to
that statement it is perfectly clear
that the Government can appropriate
funds for any purpose, whether pub-
lic or private, providing these funds
have been voted by the Legislature
of the Province, and since the Legis-
lature of Saskatchewan voted these
monies to the Icelandic Association,
as it did, within its legal powers to
do so, as I have already outlined,
the leg<d right of the Government to
pay the monies over is beyond dis-
pute. I feel certain that Mr. John-
son would not have made the state-
ments which he did if he had been
correctly adviced as to the manner in
which these grants wére made by the
Legislature and the monies paid over
by the Government in pursuance of
the provisions of The Appropriation
Act of 1928.

Samvinnumál
HVBITISAMLAGIÐ
Þrátt fyrir óhagstæöa veöráttu,
er hefir seinkað fyrir samningsleit-
unum, vinnur Hveitisamlagið sér
stöðugt nýja samningsaðila. 3. júli
t. d. bárust aðalskrifstofunni í Re-
gina 1387 undirskrifaðir samningar,
er tryiggðu því 100,000 ekrur, sáðar
ýmsum korntegundum. Er búist
jafnvel við enn örari samnings-
leitunum, er veðrið batnar og vegir
verða aftur alfærir. —
iSamkvæmt síðustu stjórnaráætlun-
um verða 22,440,100 ekrur sánar
hveiti í sumar í sléttufylkjunum
þremur, en í fyrra voru 21,425,656
ekrur sánar hveiti, og er 4.7 per cent.
meira sáð af hveiti nú en í fyrra.
I Sask.-fylki einu standa 13,239,000
ekrur undir hveiti, eða 59 per cent,
af öllum hveitiökrum í sléttufylkj-
unum þremur. Er það -2 per cent.
meira í Sask. en í fyrra.
Á öllum stærri sýningum hefir
Hveitisamlag Sask.-fylkis, tjald þar
sem sýnd eru sýnishorn af korni all-
staðar að úr veröldinni og sérstak-
lega viöurkendar tegundir frá Vest-
ur-Canada. Er öllum vinsamlegast
boiðð að lita inn í tjaldið þar sem
allar upplýsingar um Hveitisamlag-
ið eru^ látnar í té. Samlagstjaldið
og kornsýningin verður að Melfort
sýningunni 19., 20., og 21. júlí og að
Saskatoon sýningunni alla vikuna er
byrjar 5. júlí. —
GRIPASAMLAGIÐ
Samkvæmt skýrslum frá Mr. Ing-
aldson, er heldur varaö viö því að
senda óvalda gripi til markaðar fyrst
um sinn, því eftirspurn er ekki mik-
i! eftir þeim, sem stendur, og er
heldur ráðlagt að halda þeim heima,
unz þeir hafa tekið góðum holdum.
Gott útlit virðist með svinamark
að, virðist töluverð eftirspurn fyrir
það verð, sem nú er: “Thick
smooths” á 11.25 og úrvalsskepnur
50 centum meira, eins og vant er.

Þrjú héraðssamlög hafa verið
stofnuð nýlega; eitt í Langruth er
nær yfir Langruth brautina frá Al-
onso suður undir Westbourne; annað
í Eden-Birnie héraðinu, með fjórum
farmstöðvum, og þaö þriðja x Clan-
william-Erickson héraðinu.
Thos. Davidson heldur fundi á
þessum stöðum síðari hluta júlímán-
aðar: Coldwellskóla, 23 júlí; Martin-
dale skóla 24.; Wickham skóla, 25.;
Elphinstone, 26.; Horod skóla 27.;
Prince of Wales skóla, 28.; Menzie,
30 júlí.
Mr. P. K. Bjarnason er við skipu-
lagsstarfsemi í Piney og Vita hér-
uðum.
Forseti samlagsins, Mr. Ray Mc-
Phail fer um til fundarhalda þessa
vikuna. —

Sask. Livestock Producers Ltd.
hélt ársfund sinn í Moose Jaw 4. og
5. júlí. Voru þar um 70 fulltrúar
mættir frá ýmsum héraðssamlögum
í fylkinu. Var ákveðið að vinna
sem öflugast að útbreiðslu samlags-
ins héðan af til áramóta, bæði með
samlagsstofnun og samningsútvegun.
Var auglýst á fundinum, að alls
væru samningsbundnir meðlimir fél-
agsins i fylkinu 10,300.
Bending til Vestur-íslendinga
Það liggur í augum uppi, aö það
verður tiltölulega nxjög lítill hluti
Vestur-Islendinga sem ferðast getur
til íslands árið 1930, en engan efa
teljum vér á því, að hvern ein-
asta mann , sem af íslenzku bergi
er brotinn, myndi langa til að geta
á einhvern hátt tekið þátt í hátíð ti!
að minnast þúsund ára afmælis Al-
þings. Þess vegna finnst okkur að
það ætti við, að þeir sem ekki geta
farið heim, stofnuðu til hátíðar hér
vestan hafs. Þetta hefir oft bor-
ist í tal áður, oig höfum við ekki
orðið varir við nokkra rödd á móti
því. Mjög litið hefir þessi hlið
híti'ðahaldsins verið rædd opinber-
lega, og mun ástæðan vera sú, að
fólk hefir haldið að það yrði ef til
vill misskilið —að skeð gæti að sum
ir myndu álíta að hugmyndinni
væri hrint af stað einungis til þess
að skemma fyrir þeim er að ferðinni
til Islands eru ‘að starfa. En nú
hefir hr. Jón Bildfell, forseti heim-
fararnefndarinnar sjálfur drepið á
þessa hlið málsins. Vér höfum átt
tal við menn í sjálfboðanefndinni og
voru þeir á sömu skoðun og við
sjálfir. Það virðist því að þeir
sem að heimferðinni vinna séu ein-
dregið með því að hátíð verði hald-
in hér vestra árið 1930.
Ef maður lítur til baka nokkra
daga og athugar hvað Norðmönnum
tókst að framkvæma. og hafa þeir
samt rnjög fáum hér í Winnipeg á
að skipa, þá virðist enigin ástæöa
vera fyrir því, að Vestur-Islending-
ar gætu ekki stofnað til hátiðar sem
Islendingum væri til sóma. Þúsund
ára afmæli Alþingis er sá menningar
atburður í sögu, ekki einungis Is-
lands, heldur qg allra N jrður-Ev-
rópu þjóðanna, að vér erum ekki
trúir forfeðrum vorum og ættjörð ef
vér létum tækifærið fara framhjá,
án þess að minnast þess með opin-
berri hátíð, bæði austan hafs og
vestan.
Ef aö stofna á til slíkrar hátíðar
hér vestra þá er fyrsta sporið að
kjósa nefnd. Reynslan hefir sýnt
hversu erfitt það er að kjósa nefnd
sem hægt sé að segja að hafi fengið
vald sitt eða umboð frá Islendingum
í heild sinni. En nú virðist vera
tækifæri til þess og vildum vér bendt
á eftirfylgjandi aðferð. Innan
skamms verða hinar árlegu Islend-
ingadags hátiðir haldnar meðal Vest-
ur-Islendinga. A þeim hátíðum
gefst tækifæri til þess að minnast á
þetta mál og kjósa menn í nefnd.
Vér vildum rnælast til þess að fimtán
manns skipuðu nefndina: fjórir frá
Winnipeg, tveir frá Selkirk og bygð
um mieðfram Winnipegvatni, tveir
frá byggðutn meðfram Manitoba-
vatni, tveir frá byggðunum í Sask.,
tveir frá byggðum í N. Dakota og
Minnesota, einn frá Alberta og tveir
frá Kyrrahafsströndinni. Hátíðir
verða haldnar í flestum þessum hér-
uðum annan ágúst, og verður því þá
hægt að kjósa flesta ef ekki alla í
nefndina.
Vér könnumst við að það er erf-
iðleikum bundiö að skipa nefnd í
mörgum og fjærliggjandi byggðum.
En þá erfiðleika er auðveldara að
yfirbuga heldur en óánægju sem
-f*>sið gæti út af því að fáeinir menn
eða vissar byggðir tækju hátíðina
að sér.
Eitt er nauðsynlegt. Að í nefnd-
inni séu menn úr sem flestum
byggðum Islendinga. Allir í nefnd-
inni þyrftu ekki ætið að sækja fundi,
gætu oft látið í ljós skoöanir sínar
í bréfum. Að sjálfsögðu yrði
nefndin að mæta sem fyrst í haust
og skifta með sér verkum.
Hið ofangreinda er einungis bend-
ing sem vér leggjum fram, almenn-
ingi til athuigunar.
Ef Islendingar vestan hafs eru á þeirri
skoðun að æskilegt væri að stofna
til hátíðar i Ameríku þá verður að
byrja sem allra fyrst.

Aðfaranótt hins 12. þ. m. lézt að
úrnili sínu í Ethridge, Montana,
ú Guðrún Ingibjörg Einarsson,
tgsta dóttir Björns heitins Hall-
irssonar frá Ulfsstöðum, og systir
r. M. B. Halldórsson og þeirra
rstkina. Jarðarförin fer fram að
arðar, N. Dakota í dag. Hin
•amliðna var 61 árs að aldri.

Vakiimar Kristjánsson frá Winni-
peg, er suður fóru til þess að sitja
gullbrúðkaup foreldra og tengda for-
eldra, Mr. og Mrs. Kristjáns Kristj-
ánssonar, sem getið er á öörum stað
hér í blaðinu. Wynyard fólkið hélt
allt vestur eftir stutta dvöl hér, að
undanskildri Miss Dóru Gunnlaugs-
son, er bíður hér leikflokks Wyny-
ardbúa, er bráðlega kemur hér, eins
og Heimskringla hefir getið um.
Hingað kom á laugardaginn úr
skemtiferö frá New York og fleiri
stööum í Bandaríkjunum, í fylgd
með tengdasyni sínum og dóttur,
Mr. og Mrs. Anthony Fokker, hr.
Snjólfur Austmann frá Kenaston,
Sask. Sagði hann margt fróðlegt
og skemtilegt úr því ferðalagi og
munu lesendur Heimskringlu verða
þeirrhr frásagnar aðnjótandi frá hon
um sjálfum. — Mr. Austmann dvel-
ur hér í bænum nokkurn tíma enn-
þá,-
Hingað kom ferðafólk frá Wyn-
yard, síðari hluta vikunnar sem leið,
á heimleið í tveim bílum frá N.
Dakota; Mr. og Mrs. Gunnar Jó-
hannsson; svstur Mr. Jóhannsson;
Miss Th. Jóhannsson og Mrs. Dóm-
hildur Johnson og tvö börn hennar

si'tt héldu að heimili sínu við Ey-
ford, N. Dakota, hinn 11. þ. m.
Kristján Kr'istjánsson Þorsteinsson-
ar, frá Ulfsstöðum í Skagafirði og
kona hans, Svanfríður Jónsdóttir,
Benjamínssonar, en raunar höfðu
þau verið gift í 51 ár 7. júlí síðastl.
I 50 ár hafa þau verið búsett í sama
stað. — Brúðkaupið var hinn veg-
legasti fagnaður. Sátu það um
200 gestir, þar á meðal sex synir
gullbrúðhjónanna og þrjár dætur, og
fjölskyldur þeirra. Mr. Gamalíel
Þorleifsson stýrði samsætinu og af-
henti þeint hjónum digran gullsjóð,
sem heiðursgjöf frá vinum og vanda-
mönnum. Fornvinur gullbrúðkaup-
hjónanna.og vinur vor allra,K.N.,flutti
þeim kvæði, og að auki voru nátt-
úrlega margar ræður fluttar. — En
annars mun nánar verða skýrt frá
þessum fagnaöi síðar.
