My address is composed of an introduction, two parts and a con-
clusion.
The INTRODUCTION discusses the definition of the term “criminal
policy”. It further explains in how far Icelandic criminal law will be
included in the compai'ison.
1. Terminology and scope. — Criminal policy deals with the problem
of how the criminal law has to be set up in the most appropriate
manner in order to fulfil its fundamental task, that of protecting
society against crime. For the purpose of this lecture I have left
aside the more political and less professional reading of the term
“criminal policy”, i.e. the development of strategies for the final aboli-
tion of criminal law and for a fundamental transformation of society
itself into something completely new. The field of criminal policy,
when it is examined scientifically, is quite different: It is criminal law
seen as a whole and as something which is indispensable for the time
being. This view includes incriminations, such public agencies as the
police, prosecutors’ offices, the courts and correctional institutions,
the process of legislation, criminal procedure, the whole range of penal-
ties and the means of reintegrating offenders into society. Out of this
entire area, my address is intended to deal only with the sanctions of
criminal law, certainly within the broadest meaning of this term. This
includes all kinds of responses by the state to crime insofar as they
constitute means of social control.
Dr. jur. Hans-Heinrich Jescheck var um nær 30 ára skeið
prófessor í refsirétti og réttarfari við Háskólann í Freiburg
í Svartaskógi. Hann var um langt árabil forstöðumaður
Max-Planck-rannsóknarstofnunarinnar í alþjóðlegum sam-
anburðarrefsirétti, einnig í Freiburg. Frá árinu 1979 hefur
prófessor Jescheck verið forseti Alþjóðasamtaka refsi-
réttarfræðinga (AIDP). Hann hefur látið sér annt um rann-
sóknir ( samanburðarlögfræði, hefur verið i stöðugu sam-
bandi við fjölmarga erlenda fræðimenn og sjálfur flutt
fyrirlestra víða um heim. Eftir prófessor Jescheck liggja
mörg merk ritverk og sum mikil að vöxtum. Má nefna rit
hans um almenna hluta refsiréttarins, sem birtist í nýrri
útgáfu á síðasta ári. Hefur hann með störfum sínum og
ritverkum haft mikil áhrif á þróun refsilöggjafar í heima-
landi sínu, Sambandslýðveldinu Þýskalandi. Grein sú, er
hér birtist, er byggð á fyrirlestri, er höfundur flutti á
ensku í boði lagadeildar Háskóla íslands hinn 6. júní
1989.
