NOTES
since it is the right of a mother to inherit from her children which
is in question. AJ’s addition must be due to carelessness.
8738 Wigsl. 62: An error for 54 (cf. p. 354), but in 66 we
find precisely the same wrong numbering; in the manuscript the
provisions given by AJ are also underlined.
8g2s-33 AJ’s expression of the humanist theory of the scope
and function of history, see above, Introduction p. 49.
8831 Cic. 2. de Orat.: De oratore II 9, 36.
8 8 32 Herodotum: Hist. I 1.
89® scamma: Printed with Gothic characters in the edition. AJ
writes in the margin: “NB typis latinis scribendum est aut Græ-
cis, Græca vox cum sit. Un (de) prov. De scammate egredi.”
898~27 Cf. Egils saga Skalla-Grimssonar, chs. 64—5, and AJ’s
marginal note I 190 and note. His statements II 8910-14 (mention
of lodex = feldr and the compensation of 3 marks of silver)
cannot however come from Egils saga, and they are probably
from Kormåks saga, ch. 10 (scarcely from Svarfdæla saga, ch.
9), cf. Introduction above, ch. III no. 26. The reference to hesli-
stengr II 8916 would indicate Kormåks saga as the most probable
source, for there the enclosure of the duelling-place is described;
on the other hånd not heslistengr but hpslur is the word used.
Heslistengr is found however in Egils saga, e.g. p. 18721 (on the
enclosure of the place where a court of law sat), and AJ might
well have substituted this word for the rare term hpslur. Since
most of the description here discussed is also found in Supple-
mentum (I 190), AJ must have used the text in question as early
as 1597.
8928 circa annum 1006.: The abolition of duelling is spoken of
in Gunnlaugs saga ormstungu, ch. 11, and AJ certainly took his
information on it from there (cf. above, Introduction, ch. III
no. 23). He must have worked out the date for himself, since
it has not been preserved in the annals (now assigned to 1007 or
1008, see Isl. fornrit III, pp. LVin—lix). Cf. also V. Finsen, Om
den oprindelige Ordning af nogle af den islandske Fristats Insti-
tutioner, 1888, p. 116 ff.
8 9 33 in capacissimo vase: See Floamanna saga, ch. 17.
906 Saxo: See II 6, 10 (p. 51).
9022-28 Against this AJ writes in the margin: “omittantur”
