NOKKUR ORÐ UM LÖGSKýRINGARLEIÐIRNAR
Hafsteinn Dan Kristjánsson er aðstoðarmaður umboðsmanns Alþingis og aðjúnkt við
lagadeild Háskóla Íslands.
Útdráttur:
Í greininni er eðli lögskýringarleiða tekið til skoðunar út frá viðhorfum
fræðimanna. Nánar tiltekið er í fyrsta lagi fjallað um hvort lögskýringar-
leiðir hverfist í kringum orðalag lagaákvæðis eða vafa um hvort tilvik falli
undir það. Í öðru lagi hvert sé eðli rýmkandi lögskýringar og tengsl hennar
við lögjöfnun. Að lokum hvort lögskýringarleiðir feli aðeins í sér lýsingu á
niðurstöðu eða aðferðir við að velja túlkunarkost. Vikið er að kostum og
göllum ólíkra nálgana og því varpað fram að mögulega séu ólíkar nálganir
á lögskýringarleiðir að einhverju leyti samþættanlegar.
A FEW WORDS ON INTERPRETIVE CHOICES

and an Adjunct Lecturer at the University of Iceland.
Abstract:
The article addresses the nature of interpretive choices in light of the views
of different scholars. Firstly, it covers the question whether interpetive
choices are focused on the wording of a legal provision or the doubt about
whether or not particular facts fall within the ambit of a legal provision.
Secondly, it talks about the nature of extensive interpretation and its rela-
tion to analogy. Thirdly, it addresses the question whether interpretive
choices are a description of a conclusion or methods for choosing an inter-
pretive choice. Pros and cons of different approaches are covered and it is
claimed that the different approaches can, to certain extent, be harmo-
nized.
