not explore the continental shelf or exploit its natural re-
sources, no one may undertake these activities, or make
a claim to the continental shelf, without the express con-
sent of the coastal 'State.
3. The rights of the coastal State over the continental
shelf do not depend on occupation, effective or notional,
or on any express proclamation.
4. The natural resources referred to in these articles
consist of the mineral and other non-living resources of
the seabed and subsoil together with living organisms be-
longing to sedentary species, that is to say, organisms
which, at the harvestable stage, either are immobile on
or under the seabed or are unable to move except in con-
stant physical contact with the seabed or the subsoil.
Article 3
The rights of the coastal State over the continental shelf
do not affect the legal status of the superjacent waters
as high seas, or that of the air space above those waters.
Utnyttelsen av rikdommene pá kontinentalsokkelen var
den gang, altsá for en ti-tolv ár siden, forholdsvis ny. Ná
er vi kommet meget lengre. Ná er det tale om á utnytte
det som er pá havbunnen eller under havhunnen. Og det
er et helt annet problem.
Grunnen til at dette sporsmál er blitt et av de store og
aktuelle sporsmál i moderne politikk er at det ble satt
opp pá dagsordenen ved FN’s Hovedforsamling hosten
1967 etter forslag fra Malta. Og dette ledet til en debatt
i Hovedforsamlingen som igjen ledet til at det ble nedsatt
en forelopig komité pá 35 stater til á forberede arbeidet
med denne viktige sak.
Báde Island og Norge var med i denne komitéen. Den
hadde flere moter og vedtok en god og inngáende rapport
som igjen forte til at det ble nedsatt en permanent hav-
bunnskomité med 42 medlemmer hvor ogsá báde Island
og Norge er med.
