2.3 Alþjóðlegir samningar, yfírlýsingar o.þ.h.
Nú verða nefnd nokkur dæmi úr alþjóðlegum rétti um skyldu til þess að láta
fara fram mat á umhverfisáhrifum. Ég mun hér einungis birta íslenskan texta
liggi hann fyrir í Sjórnartíðindum eða í þingskjölum.
í World Charter for Nature, frá 1982, er í (b) lið 11. gr. að finna eitt slíkt
dæmi. Þar segir: „(b) Activities which are likely to pose a significant risk to
nature shall be preceded by an exhaustive examination; their proponents shall
demonstrate that expected benefits outweigh potential damage to nature, and
where potential adverse effects are not fully understood, the activities should
not proceed;“
Umhverfisstofnun Sameinuðu þjóðanna (UNEP) hefur látið sig málið varða
og árið 1987 voru gefnar út leiðbeiningar varðandi mat á umhverfisáhrifum,
Goals and Principles of Environmental Impact Assessment. Leiðbeiningarnar
taka að mörgu leyti mið af NEPA lögunum bandarísku þótt þær eigi við um ein-
stakar framkvæmdir. í 4. gr. leiðbeininganna er fjallað um innihald mats á um-
hverfisáhrifum og segir í þeim að í matsskýrslu skuli vera:
(a) A description of the proposed activity;
(b) A description of the potentially affected environment, including specific
information necessary for identifying and assessing the environmental effects of
the proposed activity;
(c) A description of practical alternatives, as appropriate;
(d) An assessment of the likely or potential environmental impacts of the proposed
activity and alternatives, including the direct, indirect, cumulative, short-term
and long-term effects;
(e) An identification and description of measures available to mitigate adverse
environmental impacts of the proposed activity and altematives, and an assess-
ment of those measures;
(f) An indication of gaps in knowledge and uncertainties which may be encount-
ered in compiling the required information;
(g) An indication of whether the environment of any other State or areas beyond
national jurisdiction is likely to be affected by the proposed activity or alterna-
tives;
(h) A brief, non-technical summary of the information provided under the above
headings.
Svokallaður Espoo-samningur frá 199126 fjallar einvörðungu um mat á um-
hverfisáhrifum og er gildissvið hans bundið við umfangsmiklar framkvæmdir
þegar búist er við að umhverfisáhrif vegna þeirra fari yfir landamæri. Samn-
ingsaðilar skuldbinda sig til þess að meta umhverfisáhrif þessara framkvæmda
áður en í þær er ráðist og ber þeim að tryggja að gerð sé matsskýrsla og að al-
