cies, and in many cases spe-
cial legislation, or data pro-
tection regulation, is thought
necessary.
But, for a number of rea-
sons, the database proposed in
Iceland lies well beyond the
limits of established prece-
dent:
Firstly, the proposed sys-
tem will be intrinsically more
difficult to protect than exis-
ting health databases, because
it contains information on
genealogy as well as health,
and because it is proposed to
allow access to a large and
transient population of com-
mercial subscribers, rather
than a few carefully vetted
statisticians;
Secondly, the proposed
database will also be available
to the Ministry of Health for
tasks such as cost control.
This will be the first time that
medical records on Icelanders
are available centrally to the
government rather than being
kept locally in health centres
and clinics. This raises a num-
ber of ethical and other issues,
which appear to have escaped
debate;
Finally, despite this envi-
ronment of greatly increased
privacy risk compared with
existing systems, the mea-
sures which are proposed to
limit the scope of users' en-
quiries, and to provide tech-
nical protection in other ways,
are not credible. There is not
even enough information
about the proposed use of the
database to determine whet-
her effective protection mea-
sures are feasible.
In conclusion, the propo-
sed database falls outside the
boundaries of what would be
acceptable elsewhere in Eu-
rope. If established as pro-
posed, it would likely cause
serious conflict with the ethi-
cal principle that identifiable
health information should
only be made available with
the consent of the patient.
I therefore recommend that
the Icelandic Medical As-
sociation oppose the current
bill. This need not rule out the
possibility of supporting an
amended proposal, in which
the uses of the database are
clarified and appropriate se-
curity measures included.
Finally, I wish to point out
that the proposed database is
also in conflict with establis-
hed data protection principles.
If data protection authorities
overseas acquire the view that
Iceland is a country in which
normal data protection con-
trols can be bypassed easily
by powerful vested interests,
then this could have extreme-
ly grave consequences for
trade and development. I
therefore caution Icelanders
against considering the matter
to be a simple choice between
national development and me-
dical privacy.
Alþjóðafélag lækna fjallar um
gagnagrunnsfrumvarpið
Á fundi Alþjóðfélags lækna, World Medical Association,
sem haldinn var í Ottawa um miðjan október síðstaliðinn, var
kynnt frumvarp til laga um gagnagrunn á heilbrigðissviði, að
frumkvæði norrænu læknasamtakanna sem tekið hafa undir
sjónarmið Læknafélags íslands í málinu og varað við sam-
þykkt frumvarpsins.
Norrænu læknasamtökin lögðu einkum áherslu á eftirtalin
álitamál:
- Ekki er unnt að sjá fyrir siðferðilegar afleiðingar þess að
mynda slíkan miðlægan gagnagrunn á heilbrigðissviði
fyrir heila þjóð.
- Upplýsingarnar verða undir stjóm einkaleyfishafa sem
nýtir þær í þágu eigin rannsókna.
- Sú staðreynd að einkaleyfishafi getur neitað vísindamönn-
um um aðgengi rekist rannsóknir þeirra á viðskiptahags-
muni leyfishafa.
- Sá möguleiki að þetta leiði til fullkominnar skráningar á
erfðaefni heillar þjóðar.
- Sú staðreynd, að þrátt fyrir dulkóðun gagna, er samsetning
íslensku þjóðarinnar þannig að hætta er á að unnt reynist
að bera kennsl á einstaklinga og brennimerkja þannig heil-
ar fjölskyldur og einangruð samfélög, en það er í andstöðu
við stefnu Alþjóðfélags lækna um trúnað við geymslu
heilsufarsupplýsinga.
Engin endanleg afstaða var mótuð á fundinum en þeirri
áskorun var beint til aðalritara Alþjóðafélags lækna að hafa
samband við Læknafélag Islands til að ræða hvernig unnt
væri að koma á framfæri við ríkisstjórn íslands afstöðu Al-
þjóðafélags lækna í þeim siðferðilegu álitamálum sem tengj-
ast frumvarpinu.
